Can any kind of lawyer charge up front fees for loss mitigation services?
I ask b/c the CA statute states that "A person licensed to practice law in this state when the person renders service in the course of his or her practice as an attorney at law" is exempt from the foreclosure consultant statutes. Does this apply to loss mitigation companies that hire an in house attorney? If the company has an attorney can they charge advanced fees or does it have to be an attorney working through his/her law firm?
To clarify, I have been told by NUMEROUS attorneys that if an attorney is in house counsel for a loss mitigation company and they attorney represents the company's clients in the loss mitigation, it is an ethical violation. That as an attorney, loss mitigation can only be done through that attorney's law firm -- not the loss mitigation business itself. I want to know if this is true. I hope that helps to clarify my question.
I was told by a CA attorney that, "[an] attorney is exempt as long as the attorney is not affiliated with the company doing the work (i.e. an attorney in the practice of law would be exempt, not an attorney hired by the company to skirt this exemption). Public non-profit companies are exempt from the law as well (but not private foundations). "

Any Loss Mitigation Consultant Out There?
Does anyone know about becoming a Loss Mitigation Consultant? Is this for foreclosures?
I am looking for a job and I came across postings in becoming a Loss Mitigation consultant. Since I'm familiar with the mortgage industry, I thought this would be a good area for me. However I have found that a lot of these websites charge you to become a consultant. Is this the way it usually is or are they just trying to make more money?
Is anyone here a current loss mitigation consultant?
Has it worked for you?
I really don't want to throw my money away but I would like to get into the Foreclosure area because I know lots of people going through this now.
Career as a loss mitigation and foreclosure specialist?
I am interested in making loss mitigation my career but I have a few questions about it. Would this be a lucrative career path? What are the job duties of a loss mitigation specialist/ foreclosure specialist? Is the job salary based or commission based?
Any insight would be helpful. Thank you.
