Question: My mom is borrower and i am co borrower. She is filing Bankruptcy. How does this affect me?

My mom has decided to file BK due to some financial struggles. My husband and I live in the house with our children and have been the only ones making the mtg payments. My mom wants to take the house into BK. The mtg is extremely high and we are not sure if we can afford it anymore. In the mean time we are in the process of trying to get the loan modified. My question is, how will it affect me if the house goes in with her BK? We are going to see a lawyer on Monday but i am curious to see if anyone knows? Im not sure that we have another choice if the Loan modification doesnt get approved. We will have to walk away from the home which will be absolutely heartbreaking. I just got laid off and we are struggling financially. It is going to suck!




Answer: Hate to say it, but if she discharges the mortgage in her filing, the bank will then come after you for the payments.

She should try and file for a chapter 13, (restructuring of debts) this would lower the mortgage payments and you would be safe. If the Chpt 13 fails, then you are on the hook for the money.
